Black soot is an air issue. Check your air filter to make sure it's not clogged somehow. I had the problem once on a bike. Take off the air filter and see if the problem changes.

Earthman, Do this first get a chair and put it next to the Scoot. Start the scoot and sit down in the chair. Now listen to it Idleing, does it Idle nice and steady or does it Idle high and then Low and repeats this as you are having a beer in your chair. Alleyoop

Earthman, It is running LEAN, Richen Air/Fuel mixture, or you have a Dirty Carb and the Idle passages are blocked, or you have Air Leaks. But either way it is starving for gas. Alleyoop

FANTASTIC!!! Great to hear your happy as a lark. As for the emission stuff a lot of folks just take them off and plug them up Just leave your Valve cover vent line on. You can tie it up high so if it squirts a little oil out it will drain back down and not get oil splattered on your engine or parts. The more hoses you have going all over the place the more potential problem with air leaks and the scoot will run like crap. my .02 Alleyoop

well i got a new starter in it AND a new auto choke. but it's still not starting like it should.
Things i still need to replace
1. Battery
ya that's pretty much all that's left
but heres what is still happening. The auto choke is working i can tell by how the bike acts once it's started. The problem is still well starting it. So far, jumping off another 12v batter, taking the air filter off, and manually choking it by hand by plugging the inlet hole makes it start.
Now i'm sure this has something to do with it being 23 degrees outside the past few days but still that should be something i need to do.....
It idles fine now too and the reving issue is completely gone
I'm almost wondering if either my jets need rejetting or is the value needs to be adjusted again with the new auto choke.
anyways guys let me know your thoughts on this cause i'm getting to the point where i may just throw in the towel on this and take it to a shop and having THEM look at it.

Scooterfox007, Well you already know what the problem is, and that is it is NOT getting enough fuel when cold. Your auto choke is working that is good, how about your Air/Fuel Mixture how many turns is it out. In this cold weather it should be AT LEAST 2 1/2 to 3 turns out. If it needs more than that then you need the next bigger PILOT JET. Don't give up man you are almost there. Heck my Air/Fuel mixture is out 3 turns I have a manual choke on mine and I raise the Plunger and it starts right up and it single digits here. My rpms climb up to 1900-2000 I let it warm up for about 5 minutes then take the choke off and the rpms drop to 1500. Alleyoop

thanks alley. i was hoping it was just a cold thing. My girlfriend keeps telling me it can't be the cold thing and i'm just too damn stubborn to not take it in to get it fixed. Well i let you guys know if it helped.

Give it a try, if you plug up holes on your air box what your doing is chokeing it to get less air and more fuel. Alleyoop

Earthman, Thanks for the Kudos, but there are many others as well that help with ideas and suggestions on what can cause certain symptons and how to fix them. I just happen to know carbs working on them and re-building them on my Hot Rods. What I get a joy out of is when the fix is simple and doesn't cost anyone any money, just a little patience and time.
What is missing in the world of mechanics is the ability or lack thereof to diagnois a problem and treat that illness. But unfortunately Economics comes in to play and in most cases The DarkSide creeps in "Greed" and they will go about fixing the problem by replaceing parts and charging the poor soul a ton of money.
