Be a little more specific.

Yes, they have to give you a reason, if not you have to ask WHY NOT. Alleyoop

the lady there said they do not register 49cc scooters they can not be on the road ,but I told her it was street legal. was it because I said it was a scooter instead of a moped ? I purchased it from a private owner. when I fill out the registration form should it be for a moped ?

It depends on what it says on the TITLE, doesn't mean anything what you call it. Alleyoop

Why would they even ask you the engine size? Here's a NYS DMV form dmv.ny.gov/forms/mv82.pdfThey don't ask you engine size, mine was on the MSO. I think you're having a failure to communicate. If you have a title it means it was registered before, if you only have the MSO then the only question they would ask is, "what's the top speed?" to determine its class. www.dmv.org/nj-new-jersey/other-types.phpStreet-legal scooters, not the toy variety, must be registered and titled with the state, regardless of motor size. These vehicles are treated as motorcycles and will be tagged and titled as such during registration. They must meet safety requirements, and pass an emissions test, and you'll need to provide the manufacturer's certificate of origin or the original title signed over to you. Be sure to take along the Bill of Sale and proof of insurance.Go back with this and show it to DMV. There's no distinguishing size so you have a bike in Jersey's eyes.
