alright so I got the moped to start but I can't get the rpms to go above 1 any ideas on that also to get it to start had to take starter off and free it up and then it started

SO what was it? the Battery, bad connection or bad starter or bad solenoid?
What kind of carb do you have? 1. The throttle cable goes into the top center of the carb. 2. The throttle cable is attached to a bracket on the right side of the carb?
It would help a lot if you took some pictures of the CARB AREA. Alleyoop

The starter just wasn't turn we took it out and clean it and put it back on and it worked so I'm guessing that the starter is going bad I'm at work now but tomorrow I'll take some pics of the carb and post them but I'm pretty sure that throttle cable is is on the right side and on the left side it has a electronic choke

Oh, ok you have a CVK carb then not SLIDER type.
Is the carb old and looks all funky or is it nice and clean.
Turn the FUEL RATIO MIXTURE screw Clockwise until it stops and then turn it COUNTER CLOCKWISE 2 1/2 turns and see if it acts a little better. 2 1/2 turns out from the closed position is a good starting point for the fuel mixture. From there you can fine tune it to get the HIGHEST IDLE out of it after the about 5 minutes of idleing to let the ENRICHER CUT OFF the extra fuel.
If the carb is old it could be the DIAPHGRAM is ripped and or has holes in the rubber which will not raise the NEEDLE out of the main jet. Alleyoop

It don't look real bad but the enricher isn't hook up I need to get the little clamp that holds it on but other than that looks pretty new also by the enricher on the carb it looks like a vac hose might be missing but I'm not sure

If the ENRICHER IS NOT HOOKED up IT IS FEEDING EXTRA FUEL ALL THE TIME, you have to hook up the ENRICHER.
Or if the HOLDER for the ENRICHER happens to be HELD ON BY TWO SCREWS then I can tell you how to DE-ACTIVE the enricher. Take a picture of the hoses that you think is missing and the LEFT SIDE of the CARB where the ENRICHER IS. Alleyoop

Yea it has the 2 screws that hold it on so you can just deactivate it

I do not mean the two screws that hold the CLAMP DOWN I mean on the side of the carb that holds the piece that the enricher fits in? Does it look like this, SEE THE TWO SCREWS HOLDING the whole enricher system onto the carb. Does your carb look like this: Alleyoop

BUMMER, well you cannot leave it open like that, you will need to either make a "C" clamp or get a new Carb or if you have a scooter shop near you they may have old carbs laying around that they will give you the "C" clamp off of one of them. Alleyoop

So I got it running with new carb tried new spark plug also but had to put the old one back in wouldn't fire also would not go over 25mph at 5 rpm full throttle any ideas on how to speed it up or why new plug wouldn't fire

Maybe you got the wrong plug or the gap is to open or to closed. The gaps should be anywhere from 26-32 most of us gap them at around 28. Did you adjust the carbs Fuel Ratio Mixture to get the highest idle out of it after it is nice and warm at least five minutes idleing then you can adjust it.
After that if it is still just getting up to 5000 rpms, I would check your weights in the Variator they may be to heavy and limiting the RPMS. If you do not have a small scale that weighs in grams you can take a roller to the post office and ask them to weigh the roller in grams and then you will know what is in there and we can work off that.
