Ok new replacement motor came today pretty much stripped down. Ok so my question is ther a difference on the rear between the motor on setup for drum rear break vs disk? My original motor is disk and this motor came with drum breakpads installed on it. So wondering if it will even Work with my wheel?

If its anything like mine, chances are the wheel will go right on, but you'll need to either disable (or remove) the drum brake components or swap out the brake lever for a drum brake model.
I'm going through the same thing with my new motor, even though mine is a mere GY6, not a 244cc. I'm leaning towards converting mine to a rear drum, since I've had issues with the rear caliper in the past. I just need to order the brake cable and the brake lever to go with it.

I believe the drum brake set up uses a 10 inch rim so you most likely will not be able to use a 13 inch rear wheel even if you could change over to drum brakes. The left crank case assembly is most likely shorter than the disk brake set up. Measure the distance from the end of the crankshaft to the rear axle to confirm this.

Does not matter right now anyway. I will not PUT THIS PIECE OF crap in my scooter. At first glance it looked ok. but Man looks like they pulled it out of a scooter they ran for 5000 mile on the same OIL and Antifreeze that came with the thing.

If it was me, I would hesitate to use this engine even if it was new because of the wheel size problem. I think you have 2 good reasons to return this engine on their dime (used and wrong engine) and they still have not honored the warranty.
