My moped I just got yesterday works fine speed wise and great acceleration ;D. The problem is it stalls without gas when I start it up. Sometime it stalls out after awhile also. You think its the carb or do I have to open my wallet up more?

Check your valve clearances. You don't say which motor in your 250 but I suspect it's the Linhai which needs a few adjustments in the first 10,000 miles.

Yeah, you've got the Linhai 257cc engine, so check out the intake valve cover on top, two bolts hold it on, if your drill a couple holes in the battery box you can access the valve without taking any plastic off. Just use a swivel 8mm socket on an extension, and a magnet to keep the bolts captive so you can lift out the cover.
Then the exhaust cover has 3 bolts, kinda tricky to get to, one requires an 8mm box end wrench, but again, just loosen the right bottom side panel and drop the belly pan on the right side, prop it down with a board, then reach yer little monkey hand up in there and git her done.

Ok it sounds like your saying when I run out of gas, how come it wont start!! Geez!

ou need gas ,spark, and compression for it to run if you run it out of gas it takes a little while for the carb to fill back up
