I found alot of oil in a little air filter pad. and the air box filter i guess relief hose was full my bike bogged out and smelt like it was flooded or really rich i am however riding at the moment with out an exhaust or header im at 4550 on the bike is it typical to build up oil like that in the air box?

No header or exhaust can cause too much air flow and an increase in vacuum on the crankcase vent. That might be pulling the oil up. You're also looking at damaging the exhaust valve from cool air getting up there.
I'm not sure what your intake system looks like but the crankcase vent hose usually connects into somewhere between the air filter element and the intake opening. If it's partially blocked where the fresh air enters you'll get increased vacuum on the case and it'll pull a bunch of oil up. The small filter you mentioned might have something to do with it and sometimes a hose gets blocked.
Also, too much oil in the case can do it.

riding at the moment with out an exhaust or header... Worst thing you could...Exhaust valve and cold air is trouble for sure, even in the heat of the summer... Get the exhaust system back on an and your problem may be cured. Hope you have no valve problem from running it that way, I would push it or tow it if mine broke on a ride.

i cleaned the filter it cranks and wants to start but i think its dead im just going to sell it for a few hundred on craigslist

WHY? They are easy to repair. I take it you don't like to ride? Has it got spark? You need to have the exhaust in place to run right. with out it you can damage the valves. Speaking of valves when is the last time you adjusted them?

my dumbass fixed the air filter box to carb connection was off and sum how spark plug connection came undonne just enough to not start and enough to pass my eye for being connected...now im going to put an exhaust header on thanks guys
