my question is do you have to have the kickstarter gear on the scooter, because I was trying to take the clutch off and my C clamp came around and broke it off the case inside. No case oil leaking from engine case I just try to put it back into the cam opening and the case is crack so I can't put it back in . So can I just leave it out of the scooter ?
Also other question I change the coil on the scooter also because my battery wasn't staying charge . So I replace it and its still not keeping charge I drive it daily and I have to charge it by the end of the week because the battery go dead . Yes it is a brand new battery , I bought that to thinking the battery was no good, but its doing the same thing to the new battery. also I have to take my fuse out every time I turn the scooter off because my tail light and headlight , and gauge lights stay on, don't know why but its a pain in the butt. I have talk about it before in other forms but everything guys ask me to check its good. On this problem I have change the refg. and coil , cdi , check my grounds, the control for the on and off switch , and key switch. still don't know whats wrong. So if I pull the fuse every time I turn the scooter off that should not pull on the battery still right?

Can you post a picture of the damaged caseing ? As it`s cracked, even though there is no oil leakage at the moment, as soon as the engine starts then oil might start to seep out which won`t be good. If the crack doesn`t leak, then you can leave the kickstart mechanism off, and just rely on the electric start.
As for the battery, have you got a multimeter ? If not then buy one, they`re cheap enough. Put the red lead from the meter on the positive terminal of the battery and the black lead on the negative terminal. Start the engine and tell us what voltage reading you are getting. It should be about 13-14.5 volts.
