Try a written complaint with the Attorney Generals office of the state the dealer is located in. My wife does this all the time and it really rattles some cages. It could rattle the right cage so that you get the proper parts.

I have heard that the 05 and earlier models are better quality than later models. See the world of information here, forums.stellaspeed.com/Keep in mind that like any forum there are way more calls for help than people posting about their bike running flawlessly.

Wow. Some luck. First you get a Tomos at a really good price (of course you put some work into it) and then you flip it for an MB5. I must say I am a bit envious. Well, I have had my share of good deals before. Keep us posted, and let us know if you decide to get the 70cc kit for this bike. I hear that it really makes the bike a screamer. Five minutes later I find a Tomos for just $200.00 without even looking too hard. (Now if I just had the money.) Sounds like you have a short somewhere in the wiring, or, one of the electrical connectors has come unplugged. So, check all the connections and if that does not work start looking for a shorted out wire, or a loose grounding wire.
